Employment changes loom

Polly Jeanneret, employment lawyer at leading London-based law firm Halebury comments on the rise in the maximum unfair dismissal limit which came into force on 1st February and other changes.
“Although the potential maximum compensatory award in any tribunal hearing is rising from 1st February 2012 from £68,400 to £72,300, there may be fewer employers who will have to pay out at all.
“This is because the rise in the limit is to be quickly followed by the Government’s proposed plans to change the unfair dismissal rules so that employees need to have a minimum of two years’ service to be able to claim unfair dismissal in the first place compared to only one year now. The Government announced this major change in autumn of last year and for it to be introduced as of 6 April 2012.
“The existing rates for statutory payments such as redundancy and standard maternity pay are also increasing – redundancy pay being calculated on the basis of a week’s pay rated at £430.00 per week from 1st February 2012 as opposed to the current limit of £400 per week and standard maternity pay being hiked from £128.73 per week to 135.45 per week.”
